Better Real Estate Listing Fee Discount Terms and Conditions

  1. On or after January 24, 2022, Better Real Estate, LLC (dba BRE, Better Home Services, BRE Services, LLC and Better Real Estate, and operating in the State of California through its wholly owned subsidiary, Better Real Estate California, Inc.) (collectively, “Better Real Estate”) is offering sale customers using a Better Real Estate Agent1 to sell their home in the States of Arizona, California, Colorado, Florida, Georgia, Illinois, Maryland, Michigan, New York, North Carolina, Pennsylvania, South Carolina, Texas, Virginia and Washington and in Washington, DC (the “Current Home Sale”), up to all of the listing fee back (the “Listing Fee Discount”) if they purchase (or have purchased) a new home using a Better Real Estate Agent (the “New Home Purchase”) and use (or have used) Better Mortgage Corporation to finance the New Home Purchase.

  2. The Listing Fee Discount shall be one of the following:
    a. Better Real Estate sale customers who close on the New Home Purchase within the 180 days immediately following the closing of the Current Home Sale shall receive back a portion of the listing fee equal to 0.5% of the home sales price of the Current Home Sale. Such customers may instead receive back the full listing fee of 1.5% of the home sales price of the Current Home Sale if they use Better Mortgage Corporation to finance the New Home Purchase.
    b. Better Real Estate sale customers who have closed on the New Home Purchase within the 180 days immediately preceding the signing of the listing agreement for the Current Home Sale shall receive back a portion of the listing fee equal to 0.5% of the home sales price of the Current Home Sale. Such customers may instead receive back the full listing fee of 1.5% of the home sales price of the Current Home Sale if they used Better Mortgage Corporation to finance the New Home Purchase.

  3. Better Real Estate sale customers must (a) enter into a listing agreement for the Current Home Sale with a Better Real Estate Agent; (b) close on the Current Home Sale using the aforementioned Better Real Estate Agent; (c) enter (or have entered) into a purchase contract for the New Home Purchase using a Better Real Estate Agent; (d) close (or have closed) on the New Home Purchase pursuant to the aforementioned purchase contract within the applicable timeframe; and (e) if seeking the Listing Fee Discount equal to the full listing fee, use (or have used) Better Mortgage Corporation to finance the New Home Purchase as set forth herein.

  4. If Better Real Estate serves as the buyer’s broker and a Better Real Estate Agent represents the purchaser, then Better Real Estate shall agree to a buyer’s broker’s commission of 1% of the home sales price.

  5. The Listing Fee Discount shall be paid directly to the Better Real Estate sale customer by Better Real Estate within 30 days of the close of the New Home Purchase if the customer closes on the New Home Purchase after the close on the Current Home Sale and may be used by the customer in any way, or shall be a reduction in the listing fee at the close of the Current Home Sale if the Better Real Estate sale customer closed on the New Home Purchase before the close of the Current Home Sale.

  6. If a Better Real Estate sale customer conducts multiple New Home Purchases, the Listing Fee Discount shall be paid only once.

  7. The Listing Fee Discount is not available where prohibited by law.

  8. Better Real Estate reserves the right to rescind or modify the terms of the Listing Fee Discount without prior notice.
